Terms and Conditions:
AGREEMENT
Our trips are designed for people 21 years old older. Participants must agree to these Conditions (which
constitutes the entire agreement between you and us) and your booking will be accepted on this basis.
The services to be provided are those referred to in your itinerary. All participants are of sound mind
and able body to participate in the event, and do so of their own free will, Participants are free to
withdraw at any time with the understanding there will be no expectation of refund after March 15,
2023.

ACCEPTANCE OF RISK 
You acknowledge and agree that participation in activities, such as LOVALICIOUS EPICCURIOUS
ADVENTURES, involves inherent risks and dangers of accidents, personal and bodily injury (including
death) and property loss or damage. You agree that you have considered the nature and extent of the
risks involved and voluntarily choose to assume all such risks, both known and unknown, even those
risks that result from the negligence of others and assume full responsibility for your participation in
such activities and partaking of exotic ingredients cuisines, and Ingredients. Participants are solely
responsible for informing Chefs and any related staff of any food, and physical or chemical allergies they
may have PRIOIR to purchasing a ticket. As a large part of the event requires ingesting exotic and rare
culinary components and ingredients, transparency is a must! Epic Curious will make every attempt to
control allergens but cannot guarantee an allergen free environment. Participate at your own risk.

INDEMNIFICATION
You agree to indemnify, defend and hold harmless EpicCurious Adventures, Fereyel’s Epicurean Delights,
Pohala Lodge LLC/ Hibiscus Properties LLC, its affiliates, officers, directors, employees, agents, services
providers and licensors from and against all losses, liabilities, costs (including without limitation
attorneys’ fees and costs on appeal or at trial), damages, judgments, claims, of every kind and nature, to
the fullest extent permitted by law, arising from or relating in any way to (i) your use of the Site, (ii) the
products and services purchased through the Site, (iii) any liabilities, claims, claims, damages and injuries
arising from or related to any act or omission of a Service Provider or another third party, (iv) your
conduct in connection with the Site, or (v) your violation of these Experiences Terms, the Terms of
Service, any law or the rights of any third party.

PHOTOS, MARKETING, AND PUBLISHING
You consent to us using images or video of you be taken during the trip for advertising and promotional
purposes in any medium we opt for. We assure you that we only use images or video of you for
Epiccurious Adventures marketing purposes (i.e., your photos will never be sold without your
permission). You grant us royalty-free, worldwide, irrevocable license, in perpetuity to use such images
for Epiccurious Adventures publicity and promotional purposes.

GUIDE/ DESIGNATED PERSONNEL AUTHORITY
Retreats are run by a Epiccurious Adventure’s trained Guides, staff, and Chefs, along with authority
granted by Pohala Lodge LLC/ Hibiscus Properties LLC, who is the Final authority on all decisions that
affect the health, safety, and/or well-being of participants. Any decisions made by the designated
personnel are considered final. If you fail to comply with a decision made by a Designated Personnel or
interfere with the well-being or mobility of the event, worker, agents, or participants, the designated
Personnel may direct you to leave the premises immediately, with no right of refund. We may also elect
not to carry you on any future trips, or activities booked. Immediate termination of your stay on Pohala
Lodge property as well as, participation in any further planned activities may occur if at any time you
engage in illegal or restricted activities, as well as, activities and/or behaviors deemed dangerous by
designated Guides or personnel, without refund.

LUGGAGE
Due to space constraints in transportation, you are limited to one piece of luggage, one day pack, and
one personal item (i.e. purse). You will be responsible for carrying your own luggage between locations
and up flights of stairs.

CANCELLATION
If a Lovalicious Sales does not meet the minimum participant requirement, by March 15, 2023, we
reserve the right to cancel, a full refund will be issued for those who have reserved their spots. Our
participants’ safety is always of the utmost importance, and we reserve the right to cancel at any time
due to political instability, threat of terrorism, natural disasters, or other external situations that would
affect the safety of the Event. In such case, we will fully refund your ticket costs.
We are not responsible for any other charges you may have incurred with the booking (i.e., flights,
hotels, travel insurance, etc.). If we cancel the trip, we will refund you all monies paid including the
deposit.
